A childcare services agreement must be entered into between the parent and the childcare provider, i.e. a childcare centre, day care centre or home childcare provider.
There are two types of childcare service agreements:
Agreements for subsidized childcare providers The ministère de la Famille has developed a model agreement and models of special agreements for subsidized childcare and day care centres so that clear guidelines can be established between the providers and the parents who use their services.
The models of special agreements are used for the following services:
Subsidized home childcare providers may use the models, but this is not mandatory.
Agreements for non-subsidized childcare providers and home childcare providers, whether they are subsidized or not Non-subsidized childcare providers and home childcare providers, subsidized or not, must enter into a successive performance service contract (see definitions) with the parents. Subidized home childcare providers who do not use the model agreement provided by the Ministère must enter into an agreement of the type successive performance service contract with the parents. Cancellation of a childcare services agreement A childcare provider may cancel a childcare services agreement when a parent does not fulfil his or her obligations repeatedly, for example, if the parent fails to pay the required contribution several times. Parents may cancel a childcare services agreement at any time, at their discretion.
Successive performance service contract A contract binding at least one of the parties to obligations over a more or less long period of time (e.g. contracts with health clubs, language schools, driver training schools, personality development courses institutes, tanning salons)
Parents of children who attend a childcare establishment.
Agreement for providers of subsidized childcare services The childcare service agreement comes into effect on the date indicated in the agreement as the start date for the child's attendance. The parent benefits from the reduced-contribution rate as of that date. Agreement for providers of unsubsidized childcare services and providers of home childcare services, whether subsidized or not The childcare service agreement comes into effect on the date indicated in the agreement as the start date for the child's attendance.
The use of the prescribed reduced-contribution childcare and, where appropriate, of specific agreement templates, has been mandatory since October 31, 2008.
