A temporary assignment consists in a worker being assigned to a duty other than his or her own duty after sustaining an employment injury (see definition), although the injury is not consolidated, while waiting for the worker to again become able to carry on his or her employment or a suitable employment. It is aimed at promoting the worker’s rehabilitation and his or her prompt return to work. It applies with the prior agreement of the attending physician. NoteA worker who does not believe he or she is able to carry on the work required can contest a temporary assignment. The worker is then not obliged to perform the assigned work until a decision is rendered. However, the worker’s income replacement indemnity may be reduced or suspended if he or she refuses an assignment that his or her physician deems safe.
Employment injuryAn injury or a disease (including its aggravation, relapse or recurrence) arising out of or in the course of an industrial accident.
ClienteleAny worker, or person considered as such by the Commission des normes, de l'équité, de la santé et de la sécurité du travail, who has become unable to carry on his or her employment because of an employment injury (see definition). NoteVarious terms and conditions apply when an employment injury occurs in a border region or outside Québec. ConditionsA worker must be reasonably able to carry on the proposed work according to his or her attending physician. Furthermore, the duties to be performed must promote his or her rehabilitation and involve no danger to his or her health, safety or physical integrity.
During the temporary assignment period, the worker is entitled to the salary and benefits for the employment he or she held at the time of the onset of the injury and that the worker would have had if he or she had continued to carry on that employment.
The conditions for a temporary assignment were set on August 19, 1985, when the Act respecting industrial accidents and occupational diseases came into force.
