Chambre des notaires
When a person is presumed incapable, an application must be sent to the Chambre des notaires for a search for a mandate in case of incapacity. The purpose of this procedure is to verify in the Registres des dispositions testamentaires et des mandats of the Chambre des notaires whether the person presumed incapable prepared such a mandate with a notary or whether the notarized mandate the person left is indeed the most recent one entered in the registers.
The Chambre des notaires neither receives nor holds mandates. It issues a certificate of search to the applicant, which indicates, where applicable, the mandate last entered in the Registres des dispositions testamentaires et des mandats, as well as the name and contact information of the notary holding the mandate. If a notary’s contact information is shown on the certificate, it will then be possible to ask the notary for a copy of the mandate.
At the same time, an application must be sent to the Barreau du Québec for a search for a mandate in case of incapacity in order to verify whether the person presumed incapable prepared a mandate with an attorney.
The most recent mandate will be known only once these two searches are completed.
Note Notaries are under the obligation to enter in the Registres des dispositions testamentaires et des mandats of the Chambre des notaires all mandates in case of incapacity they draw up.
