Ministère du Travail, de l'Emploi et de la Solidarité sociale
The Ministère may claim repayment of the following amounts:
For example, persons may receive benefits that are higher than those to which they are entitled because they have voluntarily failed to declare information or have submitted a false or incomplete document. A person may receive conditional financial assistance from the Ministère while waiting to receive compensation or benefits to which he or she is entitled (for example, compensation from the Commission des normes, de l'équité, de la santé et de la sécurité du travail or the Société de l’assurance automobile du Québec, or employment insurance benefits). The conditional assistance must be repaid as soon as the person receives the awaited compensation or benefits. A sponsored person may receive last-resort financial assistance during the term of the sponsorship agreement. This can occur if the sponsor fails to respect his or her commitment to provide for the needs of the sponsored person. The amounts will therefore be claimed from the sponsor. The Ministère will issue a claim notice specifying:
All amounts covered by a claim notice must be repaid, even if the claim is contested. A contested claim does not suspend the execution of an administrative decision. In the case of last-resort financial assistance, spouses (see definitions) are solidarily liable for repayment of the amount claimed, regardless of whether the assistance was granted to only one of the adults or to the family.
Spouses Persons to whom one of the following situations applies:
Sponsored personAn immigrant who has been granted the right to settle in Québec because a third party, called a sponsor, signed a sponsorship agreement to provide for that person’s basic needs (shelter, food, clothing).
