Filing a Claim under the Guarantee Plan for New Residential Buildings

A claim can be filed in one of the following ways, depending on the situation:

If the claim concerns a reimbursement of a partial payment, the completion of the work (see definitions), or a defect or poor workmanship (see definitions) discovered after the acceptance of the building (see definitions), the claim must be submitted to the contractor and a copy provided to the Guarantee Plan manager.

If the contractor has not responded or taken any action within 15 days following the date on which the claim was filed, the following steps must be taken:

  • the Guarantee Plan manager must be notified;
  • the required fees to have a file opened must be paid.

The manager will then process the claim.

If the claim concerns the reimbursement of relocation, moving or storage expenses, the reimbursement claim must be sent to the contractor and manager, along with the required supporting documents.

If the contractor has not responded or taken any action within 15 days following the date on which the claim was filed, the Guarantee Plan manager must be notified. The manager will resolve the situation with the contractor.

The claim should be sent to the contractor and Guarantee Plan manager by registered mail.
