To request a protection mandate search by the Barreau du Québec, proceed as follows:
- Fill out the search request form.
- Attach the required documents together with your payment.
- Mail to the Registers of Wills and Mandates of the Barreau du Québec.
Communication of Search Results
If the search is positive, you will be mailed a search certificate identifying the most recent mandate found in the registers, with the name and contact information of the lawyer who has it. You must then contact the lawyer in order to obtain the mandate.
The fee is $23, payable by credit card, certified cheque or money order made out to the Barreau du Québec.
Depending on how much time has passed since the person became incapacitated, the search certificate will be sent as follows:
Less than 2 weeks |
Within 3 weeks |
More than 2 weeks |
Within 2 weeks |
The following documents are required:
- the original copy of a sworn statement establishing the applicant's interest in the incapacitated person
- the original copy of a document certifying the incapacity of the person concerned, i.e. a recent medical and psychosocial evaluation or a recent report by the executive director of a health or social services institution
If you wish to have the original documents returned to you, include photocopies of them along with the originals.
