Contesting the Lessee’s Refusal of a Rent Increase or Another Proposed Modification of the Lease

To contest a lessee’s refusal of a rent increase or another proposed modification of the lease, the lessor must file an application with the Régie du logement within the prescribed time period to have the rent fixed or to obtain a ruling on the modification. The parties must then prepare for a hearing before the Régie.
 
Before turning to the Régie, it is recommended that lessors and lessees try to reach an amicable agreement. To do so, the parties can use the calculation tool offered by the Régie to help them determine the amount of the rent increase and to serve as a basis for discussion to facilitate an agreement.
 
If the lessor does not file an application within the prescribed period, the lease is renewed with the same conditions, that is, without the proposed modifications.
 
The Régie du logement strongly recommends that lessors use its form entitled Application to Modify the Lease, which meets the applicable legal requirements.
