Notifying a Lessee of Modifications to a Lease

To notify a lessee of modifications to a lease, the lessor must send a written notice of modification of the lease, containing the required information, within the period prescribed. The Régie du logement strongly recommends using the form Notice of Rent Increase and Modification of Another Condition of the Lease, as it meets the statutory requirements.

Once the parties have agreed to the modifications to the lease, the lessor must send the lessee a written notice confirming the modifications, before the lease is renewed. The Régie strongly recommends using the form Writing Evidencing the Modifications to the Lease for the Renewal, as it meets the statutory requirements.

Proof of Delivery
The Régie recommends that the lessor notify the lessee in one of the following ways:

  • By registered mail
  • By hand (obtain an acknowledgement of receipt)
  • By bailiff
  • By any other means enabling the lessor to obtain proof that the notice has been sent and received

In the event of a hearing, proof may be required that the notice has been sent and received.
