Making a Declaration of Family Residence

You can make a declaration of family residence for an immovable (a building) in either of the following ways:
  • Add a mention to that effect in the purchase contract for the immovable, or
  • Complete the Declaration of Family Residence Made by One of the Married Spouses or by One of the Civil Union Spouses form or Declaration of Family Residence Made by the Married Spouses or by the Civil Union Spouses form, whichever applies. Then, have it signed by 2 witnesses, one of whom must be sworn in, and complete the Notice of Address form.
Each completed form must be sent to the Québec land register to be entered in the register. To do so, you must first fill out the registration form using the Réquisition d’inscription online service. Then remit the 2 forms, each of which must be accompanied by the corresponding registration requisition, by mail or in person to the registry office located in the registration division of the immovable in question.
 
A registration fee is charged for this service.
 
You can make a declaration of family residence for a dwelling for which at least one of the spouses is a tenant in either of the following ways:
  • Add a mention to that effect in the lease when you sign it, or
  • Send the landlord, by registered mail or any other method providing proof of receipt, a letter stating that the dwelling is a family residence.
