Applying for Spousal Support or a Review of a Support Amount

To apply for spousal support, you must
 
  • include a request for support in either 
      • a joint application for divorce prepared using one of the examples provided in the brochure entitled Joint Application for Divorce on a Draft Agreement, or 
      • if a legal separation, divorce or dissolution of a civil union has already been pronounced, a joint application for review prepared using one of the examples provided in the brochure entitled Joint Application for Review of Accessory Measures
  • have a lawyer fill out the Statement of Income and Expenditures and Balance Sheet form (provided by the lawyer)
  • enclose the required documents with the application
  • file all of the documents with the clerk’s office of the Superior Court in the judicial district where one of the spouse’s resides 

To change the amount of spousal support payable, you must

  • state the exact amount of support you are seeking in the joint application for review prepared using one of the examples provided in the brochure Joint Application for Review of Accessory Measures
  • have a lawyer fill out the Statement of Income and Expenditures and Balance Sheet form (provided by the lawyer)
  • enclose the required documents with the application
  • file all of the documents with the clerk’s office of the Superior Court in the judicial district where one of the spouse’s resides
