Filing a Joint Application for Divorce on a Draft Agreement

Clientele
The spouses who wish to put an end to their marriage.

Conditions
To file a joint application for divorce on a draft agreement, the spouses must:
  • Have lived apart for at least 1 year when the application is filed;
  • Have reached an agreement concerning all the consequences of their divorce.
Restriction
An joint application for divorce on a draft agreement cannot be filed if the reason for the divorce is adultery or physical or mental cruelty suffered by one of the spouses.

  2. Attach the required documents.
  3. Attach the required documents and payment of the required fee.
  4. Send the application and documents to the clerk’s office of the Superior Court at the courthouse of the judicial district where one of the spouse resides.
