Requesting Payment of the Value of Benefits Accrued in a Pension Plan Under the Supervision of the Commission administrative des régimes de retraire et d'assurances

Once Retraite Québec has sent both spouses a statement of benefits, and if the judgment terminating the marriage or civil union provides for the partition of the pension plan, the form Application for payment of the value of benefits (Partition of family patrimony) (389A) must be completed and sent to retraite Québec with the required documents.

Transfer of accrued benefits to a spouse
Retraite Québec must transfer the amounts awarded to the spouse into one of the following investment vehicles: an annuity contract, a locked-in retirement account (LIRA), a life income fund (LIF), a registered retirement savings plan (RRSP) or a registered retirement income fund (RRIF). Transfer to an RRSP or RRIF is possible only when the amounts awarded originate from the right of the member to receive a refund of contributions on the date on which the benefits are assessed. must transfer the amounts awarded to the spouse into one of the following investment vehicles: an annuity contract, a locked-in retirement account (LIRA), a life income fund (LIF), a registered retirement savings plan (RRSP) or a registered retirement income fund (RRIF). After receiving a request for transfer, Retraite Québec sends the spouse concerned a letter confirming the amount awarded, to allow the spouse to make the necessary arrangements with a financial institution.

The spouse must send Retraite Québec the name and address of the financial institution where the amounts are to be transferred and the type of investment vehicle selected.
