Requesting a Will Search by the Chambre des notaires

To request a will search with the Chambre des notaires, a person must:

  • complete the form Request for a Search of Will for public;
  • enclose the required documents with the form;
  • mail the form and documents to the Registres des dispositions testamentaires et des mandats of the Chambre des notaires.

Upon receipt of a search certificate that provides contact information for the notary who holds the last will recorded in the registers, the notary may be contacted to see the will or obtain a copy.

In the case of a probated holograph will or will made in the presence of witnesses, contact the clerk of the Superior Court in the judicial district where the will was probated, or the notary who probated the will, as the case may be.

If the notary in question no longer practises and his or her files have not been transferred to another notary, the wills that were in his or her possession are deposited with the Superior Court of the judicial district where the notary practised. To obtain a copy of a notarial will from the Superior Court, it is necessary to first have taken the steps of searching for the will and have the search certificates on hand.

If a will search concerns someone who died outside Québec, enclose with the search request the original copy of the semi-authentic act of death issued by the Directeur de l'état civil du Québec, or the original copy of an act, certificate or equivalent document, certified true and issued where the death took place, attesting to the death. If a foreign act of death is drawn up in a language other than English or French, a translation approved by the consulate or embassy of the country where the death took place must be provided.
