A will can be probated by either the Superior Court or a notary.
To have a will probated by the Superior Court:
- Prepare an application for probate using the model suggested in the publication Application for the Probate of a Will.
- Attach the required documents and file your application at the courthouse of the judicial district where the deceased resided.
To have a will probated by a notary, ask a notary or lawyer to prepare the application for probate.
To find out whether a will has already been probated, contact the court of the judicial district where the deceased resided.

Other rules apply if the deceased person was not a resident of Québec.
