To obtain a certificate authorizing the distribution of the property of a deceased person, one must
- complete the form Notice Before Distribution of the Property of a Succession;
- join all required documents;
- send everything to Revenu Québec.
Allow approximately 90 days’ lead time to obtain the certificate authorizing the distribution of the property.
The required documents are the following :
- an official document certifying the death (such as the death certificate);
- the will search certificates issued by the Chambre des notaires du Québec and the Barreau du Québec;
If the deceased leaves a will, one of the following documents is also required:
- a certified copy of the notarial will and any related codicil (act that modifies, completes or revokes a prior will);
- a certified copy of the holograph will or the will made in the presence of witnesses, signed by a clerk of the court or a notary, and a certified copy of the judgment probating the will or the minutes of the probate.
