As parents, you exercise legal tutorship over your minor child. You must represent the child in the exercise of his or her civil rights and administer the child’s patrimony.
If one of the parents dies or is incapable of exercising tutorship, the other parent becomes the child’s sole legal tutor. If both parents die or lose the ability to exercise tutorship, a dative tutor must be appointed to act as the child’s representative. Parents may appoint a dative tutor for their child in advance.
