To request reassignment to non-hazardous duties, the employee must:
- Consult her physician or, if possible, the physician responsible for health services at her workplace, and describe the working conditions and the nature of the duties she performs.
- Have the consulting physician complete and sign the Preventive Withdrawal and Reassignment Certificate for a Pregnant or Breast-feeding Worker form, if the physician deems the work dangerous for the employee or her unborn child or nursing child (if the form is completed by the consulting physician, the latter must have it validated and countersigned by the physician responsible for health services at the employee’s place of work).
- Return one of the two copies of the certificate to her employer and keep the other for her personal records.
If the employer cannot reassign the employee to other tasks immediately, the employee must contact the local office of the Commission des normes, de l'équité, de la santé et de la sécurité du travail
to exercise her right to preventative withdrawal.
